Understanding the Appraisal Clause
When May Appraisal Be Invoked?
The appraisal clause is a contractual dispute-resolution provision found in many auto insurance policies. When the insurer and policyholder disagree on the amount of loss (not coverage), either party may invoke appraisal. Learn more about your rights under the Iowa Right to Appraisal process.
How the Appraisal Process Works
Each side selects a competent appraiser. The two appraisers review the claim and attempt to reach agreement on value. If the appraisers cannot agree, they must select a neutral umpire. If they are unable to agree on an umpire, either party may petition the court to have one appointed pursuant to the policy and applicable state procedure.
Binding Award and Allocation of Umpire Fees
Once an umpire is involved, any written award signed by any two of the three becomes binding as to the amount of loss. Umpire fees are commonly shared by the parties, unless the policy or governing rules provide otherwise.
Lucas Appraisal & Umpire Services LLC provides independent appraisal and neutral umpire services in accordance with the policy language and contractual framework governing the claim.
When Is a Neutral Umpire Required?
If the appointed appraisers cannot reach agreement on the amount of loss, a neutral umpire may be selected to resolve the dispute. Learn more about our Iowa Neutral Umpire Services and how the process works.
